These Terms of Service ("Terms") govern your use of the OFFUNIT mobile application and any related services (collectively, the "Platform") operated by OFFUNIT ("we," "us," or "our"). By creating an account or using the Platform, you agree to these Terms. If you do not agree, do not use OFFUNIT.
You may use OFFUNIT if you:
OFFUNIT is a community platform built with nurses in mind, but is open to anyone in or adjacent to the healthcare and nursing profession, including nursing students, CNAs, travel nurses, retired nurses, and healthcare supporters. Verified Registered Nurses receive a badge on their profile. Verification is optional and does not restrict access to any features.
We reserve the right to refuse access or terminate accounts at our sole discretion.

You may not create an account on behalf of another person or use a false identity. One account per person — duplicate accounts may be removed.

Violations may result in immediate account suspension or termination without notice.
How we enforce this. Content posted to OFFUNIT may be screened automatically before it appears. Every profile, post, comment, and message can be reported from inside the app, and you can block any member instantly. Reports are reviewed by a human as quickly as we can, with reports involving child safety, threats, or harassment prioritized above all others. Content that breaks these rules is removed and the account restricted or banned. See Section 10 for reporting and appeals.
OFFUNIT is not a HIPAA-covered entity and does not provide a HIPAA-compliant environment. The Platform is a social and networking space — it is not intended for clinical communication or the storage of any patient information.
You must NOT post, share, or transmit any patient-identifiable information on OFFUNIT. This includes but is not limited to:
Patient names, dates of birth, or identifiers · Case descriptions that could identify a patient · Medical records, images, or documents · Any information that constitutes Protected Health Information (PHI) under HIPAA
Violations will result in immediate account termination. OFFUNIT reserves the right to report violations to applicable regulatory authorities. Users are solely responsible for complying with HIPAA and all applicable privacy laws in their professional capacity.
You retain ownership of content you post ("User Content"). By posting, you grant OFFUNIT a non-exclusive, royalty-free, worldwide, sublicensable license to use, reproduce, display, and distribute your User Content in connection with operating and promoting the Platform.

We do not endorse any User Content and are not responsible for it. We reserve the right to remove any content that violates these Terms.
OFFUNIT provides tools for users to connect with other users. We do not guarantee any matches, connections, or outcomes. You are solely responsible for your interactions with other users.
OFFUNIT is not responsible for the conduct of any user, online or offline. Please use common sense and exercise caution when meeting anyone in person.
We reserve the right to monitor communications for safety and policy compliance.
The core of OFFUNIT is free. Creating a profile, matching, messaging your matches, posting on the OffFeed, and RN verification do not cost anything and are not behind a paywall. We also offer optional paid features ("Premium Services").
OFFUNIT+ subscription. OFFUNIT+ is an auto-renewing subscription that unlocks seeing who paged you, an allowance of 25 Sparks per month, advanced filters, incognito browsing, and Rewind. It is offered in three lengths, at the following current United States prices:
The 25 monthly Sparks are an allowance, not a balance you own. Unused Sparks from the allowance do not carry over to the next month. Sparks you purchase in a pack are separate: they do not expire while your account is active, and they are used only after your monthly allowance is spent.
Prices vary by country and are always shown to you in the app, in your local currency, before you confirm a purchase. New subscribers may be offered a 3-day free trial. Payment is charged to your Apple or Google account at confirmation of purchase.
Auto-renewal. Your subscription renews automatically at the same price and length unless you cancel it at least 24 hours before the current period ends. Your account is charged for renewal within 24 hours before the period ends. You can manage or cancel your subscription in your Apple App Store or Google Play account settings, or through the "Manage subscription" link in the OFFUNIT app under Settings. If you start a free trial and then purchase a subscription, any unused portion of the trial is forfeited.
Sparks and Boosts. Sparks and Boosts are one-time purchases of virtual items, sold in packs at the following current United States prices:
Virtual items have no cash value. Sparks and Boosts are a limited, personal, non-transferable, revocable license to use a feature of the Platform. They are not property, not currency, and not redeemable for money. You may not sell, trade, or transfer them. Any unused balance is forfeited when you delete your account or when we terminate your account for a violation of these Terms, and we are not obligated to compensate you for it.
No guaranteed results. Premium Services increase your visibility or give you more ways to reach people. They do not guarantee any specific number of profile views, Sparks received, pages, matches, replies, or relationships. Results depend on how many members are active in your area, your profile, and the choices of other people, none of which we control. Buying a Boost when few members are nearby may produce few views.
Price changes. We may change prices. For an existing subscription, a price change takes effect only at your next renewal, and only after Apple or Google notifies you and, where required, obtains your consent. You may cancel before the change takes effect.
Store terms also apply. All Premium Services are sold through the Apple App Store or Google Play. Your purchase is also governed by the terms of whichever store you bought from, in addition to these Terms.
Apple and Google process all payments, so they process all refunds. We are not the seller of record and we cannot charge you, refund you, or reverse a purchase directly.
Except where a refund is required by applicable law, purchases are final and non-refundable, including partial subscription periods and unused Sparks or Boosts. Cancelling a subscription stops future renewals; it does not refund the period you have already paid for, and you keep access until that period ends.
If you live in the EU or the UK: you normally have 14 days to withdraw from a purchase of digital content. Because Premium Services are delivered to you immediately, by completing a purchase you expressly request immediate performance and acknowledge that you lose your right of withdrawal once the content has been fully delivered. Nothing in these Terms limits any refund or cancellation right you have under the mandatory consumer law of your country of residence.
You can block any member and report any profile, message, post, or comment from inside the app. Blocking removes that person from your experience immediately. Reports are reviewed by our moderation team, which may remove content, issue a warning, restrict features, or ban an account.
If we take action against your account or your content and you believe it was a mistake, you may appeal by emailing contact@offunit.app within 30 days. Tell us what was removed and why you think the decision was wrong. A human will review the appeal and we will tell you the outcome.
We do not tolerate harassment, threats, sexual content involving minors, impersonation of a healthcare professional, or the sharing of patient information. Accounts responsible for these may be terminated immediately and without notice, and reported to law enforcement or a licensing board where appropriate.
All rights in the OFFUNIT name, logo, app design, and content created by OFFUNIT are owned by OFFUNIT. You may not copy, modify, or distribute any part of the Platform without our prior written permission.
Your use of OFFUNIT is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By agreeing to these Terms you also agree to the Privacy Policy.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OFFUNIT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM.
IN NO EVENT SHALL OFFUNIT'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID TO OFFUNIT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100.00), WHICHEVER IS GREATER.
You agree to indemnify and hold harmless OFFUNIT and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Platform, your User Content, or your violation of these Terms.
We may suspend or terminate your account at any time, with or without notice, for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Platform ceases immediately. You may delete your account at any time within the app.
These Terms are governed by the laws of the State of Ohio, without regard to conflict of law principles. OFFUNIT operates in all 50 states and complies with applicable federal law.
Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the American Arbitration Association rules, except that either party may seek injunctive or emergency relief in any court of competent jurisdiction.
You and OFFUNIT agree to resolve disputes individually. Class action lawsuits and class-wide arbitrations are not permitted.
Consumers outside the United States. If you are a consumer resident in the European Union, the United Kingdom, or another jurisdiction whose law gives you non-waivable rights, nothing in this section removes them. You keep the protection of the mandatory consumer law of your country of residence, and you may bring proceedings in the courts of that country. The arbitration requirement and class-action waiver above apply only to the extent permitted by the law that applies to you.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the app and updating the "Last Updated" date above. Continued use of the Platform after changes constitutes your acceptance of the new Terms.
